Estate Administration in Massachusetts

Massachusetts laws ensure the orderly estate administration of property in a decedent's estate. There are two types of probate administration in Massachusetts: the first involves a probate estate where there is a will. In that case a persons assets will pass according to the directions set forth in the will. The second form of probate is for people who die without making their wills. This form of estate administration is called "intestacy". In both cases the probate court in Massachusetts oversees the distribution process.

Our first priority is to officially secure your appointment with the court. Then we assist you in the following: Help you Inventory all property of the decedent.; Determine the heirs-at-law and next of kin of the decedent; Prepare estate and income tax returns for you; Pay the expenses of estate administration; And finally, distribute the assets to the proper persons.

Massachusetts Probate Attorneys

Massachusetts probate laws provide that where the decedent leaves an estate, with or without a will, consisting entirely of personal property of a total value of less than $15,000, together with a motor vehicle, a simplified proceeding may be used instead of a formal probate proceeding. This is called a "voluntary administration".
